Data Protection

We need to collect and use certain types of information about people with whom we deal in order to operate effectively and provide the best service we can. These could include current, past and prospective employees, suppliers, clients/customers/tenants, applicants, and others with whom we communicate.

Bernicia takes the privacy of our customers and staff very seriously and is committed to ensuring their privacy is protected. We will keep information securely, accurately and appropriately.

 

Access to information

The Data Protection Act 1998 specifies that, on request, Bernicia must provide customers appropriate details of information that is kept, with access to copies of that information.  Bernicia is registered under the Data Protection Act and we acknowledge residents' statutory rights regarding access to personal information.

Bernicia has a Data Protection and Access to Information Policy which clearly sets out the circumstances in which we will release data and the procedure for going about this. 
Should you wish to access any data that you believe we hold about you, you will need to complete an Access to Information Request Form and there is a £10 administration fee that goes with this.

Once we receive a completed Access to Information Request Form, complete with the £10 payment we will respond within 20 working days.
Please note: we are unable to release any information without the completion of a form.

Personal data may be disclosed to other third parties provided that there is clear proof that the resident has given his or her consent, and that the identity of the person making the request has been validated.  If a request is made by a third party that is not acting on behalf of the resident, then Bernicia will obtain the independent consent of the resident before disclosing any personal data.

 

Sharing information

Personal data may be shared with statutory bodies such as local authorities, housing benefit or social services departments where the resident has given his or her consent. If we share this information it will be in confidence. Data will only be shared without consent in the following circumstances:

• To protect the vital interests of resident (eg: In life or death situations);
• To comply with the law;
• To assist in the prevention or detection of crime (eg; housing benefit fraud)
• In connection with the legal proceedings
